Click It or Ticket

Christopher Orlet has a piece in TAS this morning about seat belt laws and the rights of free citizens. He is trying to fight a ticket he received in Illinois for not straitjacketing himself into his car, and he intends to argue his case on Constitutional grounds. I can`t wait to hear the outcome!

There are all kinds of good reasons to wear seat belts.
There are NO good reasons to pass laws forcing people to wear seat belts.
Seat belt laws are, in part, further evidence a fascist nanny state is being forced on us.
Seat belt laws are, in part, another vicious effort at fund-raising by the fascist nanny state.

Good luck to Christopher but the efficacy of wearing seatbelts is undeniable with or without air bags. His contention that seatbelt use and motorcycle helmet laws are not analogous is a straw dog as well. The very same standard used in his case law example can be applied to an unbelted automobile driver.

“In State v. Solomon, the Vermont Supreme Court concluded that helmet laws were constitutional because they "directly related to highway safety: because an unprotected motorcycle operator could be affected by roadway hazards, temporarily lose control and become a menace to other motorists." Obviously the same doesn't apply to seatbelts. “

I beg to differ… if a driver loses his position behind the controls of his vehicle even temporarily, due to an impact the vehicle then becomes an unguided missile, and represents a greater menace to other motorists. Not to mention the driver becoming a loose projectile inside the vehicle.

I agree whole-heartedly that the state has overstepped its bounds in using any perceived safety issue for regulation and the associated fines for income generation.

The folks in Minneapolis now have their first “Camera cop” to catch those who run red lights and it is a smashing success. Let’s see that’s a $140.00 fine times three- hundred eleven violations a week… woo wee that’s a bunch of money! And while we are at it let’s nail those illegally turning right on a red and that’s woo wee that’s even more money….

Lazy legislators and cops looking for additional revenue without any effort are here to stay or to put it another way, Big Brother is here Now. Get used to it Chris and click it.
